What are Legal Property Documents Check before Buying a Property/Land/Plot in India[ 16 Things ]?

As a buyer, seller, broker, agent, and developer, you are duty is to check all legal documents before dealing with any property.

It is the responsibility of every real estate organization in Inda as well as foreign. As a Realtor, It’s our duty to follow legal rules to protect customer privacy and prosperity. 

Now, in this post, we will check what things or documents are required and their details. 

1. Sale Deed

First and foremost, the most important document to check before buying any property, house, or agricultural land. The sale deed confirms the ownership of the title of the property and without it, The Property can’t sell or buy.

2. Extracts

This document confirms whether your property has been entered in the local municipality records or your property has been built according to the approved plans. The extracts are a certificate or  Khata Book which will be useful to transfer the ownership of your property at a later stage.

3. Mutation Register Extract

This important document is regarding Gram Panchayat properties and it confirms the previous owner, as well as confirms whether your property existed in the jurisdiction of Gram Panchayat or not.

4. General Power Of Attorney

This document confirms the owner’s authority to witness whether the sale or purchase of a particular property is being done by an authorized person on behalf of a third party. It will be helpful when applying for a house loan. 

5. Copy Of Building Plan

If you want to construct a building or apartment, to acquire a bank loan, you have to submit a copy of the building plan designed by the statutory body to confirm the construction of the property is legal and constructed according to rules and regulations. 

6. No-Objection Certificates (NOC)

 When starting any building construction, it is mandatory to submit a NOC certificate it is available in 19 types and you can get it from different local authorities.

7. Allotment Letter

When you require your bank loan, you need an allotment letter which is given by the developer to the buyer and confirms the buyer has cleared all dues regarding the purchased property.

8. Sale Agreement

When buying or selling property, the first time, the buyer and seller make a sale agreement on the stamp paper. It includes terms and conditions, Possession date, a payment plan, specifications, property boundaries, and landmarks.

9. Possession Letter

This letter confirms the position of the buyer when he got the property ownership from the developer on a particular date. it means that confirms the ownership of the buyer.

10. Payment Receipts

When you are buying a new property, ask for payment receipts from the developer. It is useful to submit to the bank when a loan is required.

11. Property Tax Receipts

 It confirms whether the previous owner had cleared all the dues and property taxes which may be electricity bills, housing loans, and any pending dues.

12. Encumbrance Certificate

In India, if any property has the encumbrance certificate, form 15 will be issued. If the property does not have any encumbrance certificate, you will receive a form 16 certificate. This encumbrance certificate is mandatory and must check documents before buying any property. It contains all transactions of any property over a period of time. And legal documents, link documents, and how and when the property from the early days to the present owner was transferred. 

13. Completion Certificate

After completion of constructing your home, to get the duo loan amount from the bank, you have to submit this completion certificate to the concerned Bank. 

14. Occupancy Certificate

The developer will get the occupancy certificate from the local authorities and it confirms whether the house is occupied by the developer and built according to the rules and regulations

15. Physical Verification

Before all, you have to visit the plot location to verify its physical position where it is located and it is located as per the correct survey number mentioned in the document. And its surroundings and any boundary issues if everything is ok. Then, ask for the above documents and verify them clearly, once everything is ok, then proceed to buy the property.

16. Prohibited Land

Check the Property whether it is prohibited land or not. You can check it in the MEE SEVA or Registration office with the help of the Survey number. If the survey number is a prohibited area blocked by a particular state or country, then don’t buy that property.
